And this isn’t just because of how much people love getting high, but also because of the huge medical benefits from the CBD oil industry. So where can you reap the benefits?

Is CBD Oil Legal Federally?

CBD’s source is most important when determining its legal status. The most common plant is Cannabis sativa L (Cannabis) and this contains both marijuana and hemp. From a regulatory standpoint, the difference between marijuana and hemp is based on chemical composition. Specifically related to THC (delta-9 Tetrahydrocannabinol).

On December 20, 2018, The Hemp Farming Act of 2018, S. 2667 (2018 Hemp Bill) became law and formally and definitively removed hemp from the list of controlled substances. This means that all plants that contain less than 0.3% THC were now legal, and the 2018 Hemp Bill removed Hemp-derived CBD products from the CSA’s hitlist.

Which States are CBD products Legal In?

Currently, the medical benefits of CBD oil combined with its popularity has caused it to become legal in almost every state in the USA apart from 3. If you live in Idaho, Nebraska or South Dakota, unfortunately, CBD oil would not be allowed to be used here as it isn’t legal. If the need is urgent though and you want to check out one of those CBD bath bombs, definitely consider going to a hotel in one of the legal states to calm your sore body!

Only CBD Oil is Legal In 14 States

Currently, only CBD oil is legal in 14 states, however, they do all have their own requirements for use:

  • Alabama: The only way you can access CBD oil here is if it’s a state-sponsored clinical trial or if it’s a treatment for a debilitating medical condition, the official term for this is ‘Leni’s Law’.
  • Georgia: Legally prescribed to patients who have: cancer, multiple sclerosis, Parkinson’s disease and seizure disorders etc… The maximum allowed is 20 ounces of CBD oil and 5% THC. The amount of CBD oil must be higher than the THC.
  • Indiana: It is legal to manufacture, sell, possess and use CBD oil, however, the THC levels cannot exceed 0.3%.
  • Iowa: Patients suffering from HIV/Aids, cancer, ALS seizures, and several other medical conditions are allowed access to limited amounts.
  • Kansas: Adults are legally allowed to purchase and possess CBD products; however they must contain 0% THC.
  • Kentucky: State-sponsored cultivation of hemp is legal which can then be used to make CBD oil.
  • Mississippi: It is only legal for those with severe epilepsy and it’s supposed to be taken care of by a licensed physician.
  • North Carolina: It is legal for those with intractable epilepsy. It has to be made from hemp extract.
  • South Carolina: It’s given to patients with severe epilepsy disorders.
  • Tennessee: It has to be made from hemp extract, not marijuana, and it is only given to those with intractable epilepsy. It must contain trace amounts of THC.
  • Texas: Again, it’s given to patients with intractable epilepsy.
  • Virginia: Legal for any condition diagnosed by a licensed doctor or practitioner.
  • Wisconsin: It’s legal for any medical condition doctor recommended.
  • Wyoming: Although legal, it’s a lot harder to get your hands on in this state as it’s only legal for patients with epilepsy but they can only have it if they haven’t responded to other types of medication in the past. A neurologist then has to give the state’s Department of Health a statement.
  • States Where Marijuana is Fully Legal

    There are currently only 10 states in which Marijuana is fully legal for you to use without any conditions or requirements. In these places you are free to possess this drug for both recreational and medical purposes, these 10 states are:

  • Alaska
  • California
  • Colorado
  • Maine
  • Massachusetts
  • Michigan
  • Nevada
  • Oregon
  • Vermont
  • Washington
  • Washington D.C also allows Marijuana, however it isn’t on the state list. Within these states, it’s ridiculously easy to get your hands on it. All you need is proof of identity, because you do have to be 18 or over, and you can just head on over to the local dispensary.

    Medical Marijuana is Legal in 33 US States

    For all of these 33 states, you will need a Medical Marijuana Card. This is something you can get from your doctor if you show him your symptoms and he sees you fit to deserving one. This does not include, however, the 6 states that I have not listed as in these areas Marijuana is fully legal and you don’t need any requirements to acquire it.

    Currently, these 5 states do not have an operational system as of yet. This means that they don’t have dispensaries you can collect Marijuana from.

  • Michigan – One of the states where Marijuana is fully legal
  • North Dakota
  • West Virginia
  • Louisiana
  • Arkansas
  • These 13 states have decriminalized the drug and so although recreational use is strictly illegal here, if you are caught having small doses of the drug on your person you will not be arrested, and it won’t go on your criminal record. It varies in each state how much the maximum would be allowed to be in your possession.

  • Connecticut
  • Delaware
  • Illinois
  • Maryland
  • Minnesota
  • Mississippi
  • Missouri
  • Nebraska
